SEATTLE: Nike's appeal in wrongful termination suit of former Nike employee who alleges violation of Montana's Wrongful Discharge from Employment Act


Case Description Connie Johannsen (“Johannsen”), a former Nike Regional Sales Representative, sued Nike under Montana’s Wrongful Discharge from Employment Act. Johannsen, who resigned from her position at Nike, contends that she was constructively discharged. After a bench trial, the district court entered judgment for Johannsen.

Proceedings Description: On appeal, Nike contends that the district court relied on clearly erroneous factual findings and a mistaken interpretation of the Act.

Outcome: 9th circuit affirmed the lower court’s decision.
