Maryann Gallagher tells jurors Home Depot discriminated against a 58-year-old woman when it fired her from her job at one of its California stores, as trial opened against the home improvement giant.

Gallagher contends Home Depot falsely determined Patricia Tillotson took part in a scheme to give a customer inappropriate markdowns when it dismissed her. However, Gallagher claims Home Depot's dismissal actually stemmed from her age; health problems that required her to need a stool, among other accommodations; and the fact that she had earlier acted as a whistle blower in complaining about the same conduct for which the company argues they ultimately dismissed her.
