Zimmerman v. Customers Bank

CONCLUDED

Oral Argument
05/28/14 – 05/28/14

Summary

In this oral argument before the Delaware Supreme Court, the attorney representing Michael A. Zimmerman and his wife, Connie Jo Zimmerman, sought to reverse the lower court's entry of judgment by confession against his clients. The Zimmermans are Florida residents who obtained commercial loans on behalf of their companies, BBC Properties, Inc. and Governors Club Professional Center, LLC, from Eagle National Bank on or about February 24, 2006. The Zimmermans defaulted on these loans and -- in an effort to restructure -- entered into a forbearance agreement on June 21, 2011. Customers Bank sought to confess judgment against the Zimmermans. On November 22, 2013, the lower court found in favor of Customers Bank and entered the requested judgments in the amounts of $602,163.30 and $1,558,792.95 against the Zimmermans.

Outcome

The final judgment of the Superior Court, effective as of November 22, 2013, was affirmed.
