In this Energy Employment litigation proceeding, plaintiff W.L. Gore & Associates alleged Darrell Long of violating the two covenants which Mr. Long entered while being employed at W.L. Gore & Associates and using proprietary information of the plaintiff company for the benefit of the competition BHA Group, which is a subsidiary of GE Energy.

The plaintiff was represented by attorneys Charles Knapp, Randall Kahnke, Martin Lessner and Joel Schroeder. The defendant in this case, GE Energy and other defendants were represented by attorneys R. Paul Yetter, Wynn McClosky, Samuel Hirzel and Kenneth Nachbar.

Outcome

The court found that the motion to disregard Mr. Long‟s testimony on certain subjects was granted in part. When Long‟s testimony denying that he communicated, disclosed, or used any Gore confidential information after leaving Gore was stricken from the record, except to the extent if testimony was limited to communications or disclosures orally, verbally, or in paper format. The motion was denied in all other respects.
