In this Engle progeny tobacco suit, plaintiff Dianne Webb, as the personal representative of the Estate of her father, James Kayce Horner, claimed defendnat tobacco manufacturers fraudulently concealed the dangers of smoking, which caused her father's smoking addiction and his fatal lung cancer.
In the first trial. , the jury awarded $8M in compensatory damages and $72M in punitive damages.
However, on review, Florida's First District Court of Appeal found that the award was motivated by prejudice and remanded for a redetermination of damages.
