In this premises liability lawsuit, plaintiff Wanlin Yang and her fiancé arrived at a Bank of America ATM to deposit cash. An armed man approached and demanded money from Yangs fiancé, to which Yang responded by attempting to hit the robber with a car. This resulted in the robber shooting Yang through the car window, causing facial injuries.
Yang claims that the same robber had a history of targeting customers at this ATM that Bank of America was aware of, yet failed to implement protective measures or provide a warning to customers.
Defendant Bank of America claims it followed industry-standard procedure, including properly managing previous robberies. Additionally, they suggest that Yang escalated the situation, as she attempted to use a vehicle as a weapon against a visibly armed robber.
