This litigation was conducted in two phases (proceedings)
In this proceeding, plaintiff The Texas Taxpayer & Student Fairness Coalition and other plaintiffs alleged Texas Education Board and other defendants were not providing adequate money or equitable funding to meet the academic standards of the state of Texas and this was resulting in most of the students studying in public schools in the state of Texas in not getting equal opportunities to graduate from high school, with education and skills that are necessary for joining colleges or Jobs.
The Plaintiff and other joining plaintiffs were represented by attorneys Richard Gray, David Hinojosa, J. David Thompson, Mark Trachtenberg, Leonard Schwartz, Craig Diamond, John Turner, Philip Fraissinet, Marisa Bono, Holly McIntush and Micah Skidmore. The Defendant, Texas State Board of Education and other defendants were represented by attorneys Shelley Dahlberg, Nicole Bunker Henderson, Amanda Cochran-McCall, Darren Gibson, Linda Halpern, David Mattax, Amy Penn and Eric Vinson.

The court found the the school finance system was not adequately funded and inefficient. Also, that the system had created an ad valorem tax, which was a violation of the Texas Constitution.
