Summary

In this financial litigation proceeding, plaintiff Trust Company of the west (TCW) alleged Jeffrey Gundlach for breaking the covenant of good faith and fair dealing for taking away more than half of the fixed-income desk employees of TCW when the defendant opened his new firm and also alleged the defendant of stealing trade secrets for which the plaintiff sought $200 million as damages. The defendant had filed a counterclaim and alleged that TCW had dismissed him in order to avoid paying $600 million – $1.5 billion in future performance fee.

The plaintiff was represented by attorneys Steven Madison, Rhanda Osman, John Quinn and Dominic Surprenant. The defendant in this case, Jeffrey Gundlach was represented by attorney Brad Brian, Kevin Allred, Mark Helm and Gregory Weingart.

Outcome

The jury found that the defendant did breach their fiduciary duty, shared trade secrets and broke the covenant of good faith and fair dealing. They awarded no damages to TCW. Jeffery Gundlach and associates were awarded 66.7 million for past wages that TCW failed to pay.
