Summary

In this Engle progeny tobacco litigation proceeding, plaintiff Robert Sury (personal representative of the estate of William Sury) alleged Lorillard Tobacco Co and R J Reynolds Tobacco Co of fraudulent concealment of dangers of smoking cigarettes manufactured by the company, which got his father Robert Sury to get addicted to smoking at an early age and also alleged the companies of being liable for manufacturing defective cigarettes, which caused William Sury lung cancer and resulted in his death due to the disease in 1997.

The plaintiff was represented by attorneys Leslie Bryan, Laura Shamp and John Kalil. The defense in this case comprised of Lorillard Tobacco Co and R J Reynolds. Lorillard Tobacco Co was represented by attorney David Woods. R J Reynolds was represented by attorneys William Latham and John Williams.

Outcome

The jury found the plaintiff, William Sury, 60% at fault with the remaining fault split between RJ Reynolds and Lorillard evenly, each with 20%. There were no punitive damages awarded.
