Summary

In this Healthcare employment litigation proceeding, plaintiff Israel M. Stein, M.D. alleged Clinical Data Inc., a company the plaintiff founded of breach of employment agreement, which after resignation entitled the plaintiff to severance pay and benefits, and obligated him to refrain from certain conduct for a one year period, including competing with the company, using or disclosing its trade secrets and confidential business information, and soliciting its employees. The defendant in its counterclaim alleged that that Stein interfered with the auction process related to the defendant selling its Vital Diagnostics Division, including a foreign subsidiary known as Vital Scientific N.V, and used and disclosed confidential information of Clinical Data in doing so, in violation of his employment agreement.
