Soterion v. Soteria

CONCLUDED

Oral Argument
09/11/13 – 09/11/13

Summary

In this oral argument before the Delaware Supreme Court, the issue on appeal was whether the lower court abused its discretion in fixing the amount of reasonable attorneys' fees and expenses to be awarded at $842,052.67 to Soteria Investment Holdings, Inc. and other defendants. On February 1, 2011, Soterion Corporation, Robert Jones and Scott Jones filed a three-count complaint against Soteria Invesment Holdings, Inc. and individual defendants Nelson Schwab III, Charles Grigg, Fred Burke and Harry Nurkin, alleging breach of Soteria's LLC agreement and breach of fiduciary duty. The lower court awarded attorneys' fees, expenses and costs to the defendants that they incurred between February 1, 2011, and May 20, 2011 except those fees, expenses and costs associated with defendants pursuit of their tortious interference claim.

Outcome

The judgment of the Court of Chancery was affirmed.
