In this retail tort litigation proceeding, plaintiff Michael Smith (Personal Representative of the estate of Micahel Born) alleged Wal-Mart Stores Inc and its hired security service Wachenhut of being negligent in maintaining adequate security in the premises of Wal-Mart stores, due to which Michael Born was murdered in a Wal-Mart parking lot while replacing his car's headlight.
