Summary

This is an appeal of litigation for proposed "safer cigarette" alternative. Plaintiff, Rose, claims that two cigarette companies were negligent in designing their product because the "safer cigarette" should have used lower levels of tar and nicotine.

Rose, who died during the pendency of the appeal, smoked for more than 40 years, consuming more than a pack a day of regular cigarettes. She was diagnosed with with lung cancer in 1995, two years after she finally quit smoking.

This appeal took place in the NY Court of Appeals in Albany.
