In this Engle progeny lawsuit, plaintiff, the widower of Gloria Gore, alleges defendant tobacco companies are responsible for her smoking addiction, which caused the carotid stenosis and lung cancer that led to her death. Defendants contend Gloria Gore chose to smoke, despite knowing the risks and was not addicted to nicotine. Defendants also contend that her carotid stenosis, the illness that is the lynchpin to her inclusion in the Engle class, was likely caused by factors unrelated to smoking, such as high cholesterol and a family history of heart disease.
$2 million in compensatory damages, no punitives.
Allocation of responsibility:
Gloria Gore: 54%
R.J. Reynolds: 23%
Philip Morris: 23%
