Summary

In this Insurance coverage litigation proceeding, plaintiff Pin-Pon Corporation alleged Landmark American Insurance Company of breach of contract by not paying the Insurance claim that the plaintiff was entitled to. The plaintiff’s counsels argued that the plaintiff had an excess Insurance policy with the defendant apart from having a primary insurance policy with another company and when Hurricane Frances and Hurricane Jeanne stuck in 2004, the hotel properties owned by the plaintiff were severely damaged for which the defendant was liable to pay insurance coverage in accordance with the policy contract, which it had failed to do.
