Via The Albuquerque Business Journal: "Its been a long time coming, but it appears the legal battle between two giants of the extractive industries in Eddy County will be decided by a state district court jury come December.
The case was filed by Mosaic Potash in 2010, accusing Devon Energy Production Co. of trespassing on two sections of land within a mineral lease held by Mosaic, the Carlsbad Current-Arugs reported. Devons drilling in that area allegedly caused damages to the potash deposits. Further, gas and oil drilling too close to a potash mine creates a risk that methane may enter the underground work areas and cause an explosion or other problems, according to court documents."

Devon was negligent toward Mosaic but not found to have trespassed against Mosaic.
