In this Engle progeny tobacco litigation proceeding, plaintiff, the personal representative of the estate of her husband Jay Morse claims defendants fraudulently concealed the dangers of smoking and furthered her husband's addiction to cigarettes, which ultimately caused her husband's lung cancer and death.
The jury found for the plaintiff in Phase 1 of the trial, however at the beginning of the damages phase a juror submitted a multi-page handwritten letter to the judge claiming he was coerced and did not believe the verdict should be for the plaintiff. The trial results in a mistrial.
