Miller v. Dept. of Public Safety

CONCLUDED

Oral Argument
09/18/13 – 09/18/13

Summary

In this oral argument before the Delaware Supreme Court, the attorney representing plaintiff Diana Miller contended that the lower court committed reversible error when it charged the jury with the inclusion of adverse tangible employment action as an element of Ms. Miller's quid pro quo sexual harassment claim against the State of Delaware, Department of Public Safety. The trial on the quid pro quo sexual harassment claim began on July 24, 2012 and was completed on August 2, 2012. The jury returned a verdict for the defendant. This appeal is from the erroneous jury charges and the denial of the plaintiff's motion for new trial.

Outcome

The judgment of the Superior Court was affirmed.
