Garcia's attorneys assert that Jorge illegally parked the truck on the side of the road to urinate to cut travel time. And, they argue that De La Torre crossed into the shoulder to avoid a vehicle that cut him off.
Representatives for defendant Tri-Modal dispute the plaintiff's claims, suggesting that Jorge was underneath the truck and performing maintenance. They highlight records that they believe show Jorge acted properly, pulling to the side to perform maintenance when he became aware of a mechanical issue.
