Joseph Serhal fell into a ditch at around 1 am after finishing up with his shift as a casino pit boss. This ditch was allegedly due to construction workers from a public utility company digging a six-foot trench during Serhal's shift. Serhal contends that the fall caused him chronic pain, along with nerve, back, and shoulder injuries.
Serhal's attorneys argue that the utility company, NV Energy, along with Blue Star Barricade and Traffic Control, failed to erect the appropriate barricades to warn passersby of the ditch. This fall, they claim, caused Serhal to require multiple surgeries on his neck, shoulder, and back, and left him unable to continue the job he loved.
Representatives for defendants dispute Serhal's claim that there were no warnings of the ditch, insisting that workers provided him with verbal warnings that he ignored, along with setting up cones and caution tape. Additionally, they argue that Serhal's injuries were initially restricted to the leg, and that pain as severe as Serhal claimed to have would show up immediately.
