Plaintiff John Paxin suffered a broken neck after a crash in his Nissan Titan. Due to a medical event while driving, Paxin drove his truck off the road, clipping a car in the process, but not rolling over. However, the side curtain airbag improperly deployed, as the computer sensed an imminent rollover. Paxin suffered a broken neck, which rendered him a quadriplegic.
Paxin claims that this improper deployment broke his neck, and that Nissan knew the computers on their vehicles were faulty but did not issue a formal recall to save money.
Defendant Nissan claims that Paxin broke his neck after driving off an embankment, which ultimately stopped the truck. Representatives for Nissan point to one of Paxins medical conditions that allegedly makes his neck more brittle. Nissan claims that their side airbags only deploy when a rollover is imminent, and the crash from the embankment was severe enough to trigger the computers prediction that the vehicle would flip. While the truck ultimately did not roll over, Nissan asserts that this system functioned properly.
