In this construction negligence proceeding, Plaintiffs Steven Wosinski, Dawn Kellner and Milwaukee County alleged Advance Cast Stone Co. of being negligent in manufacturing and installing over 100 precast concrete panels for O Donnel Park, which resulted in a 13 ton concrete panel falling in the parking garage of O Donnel Park and killing 15 year old Jared Kellner while injuring two others. Plaintiff Dawn Kellner is the father of the deceased, Jared Kellner. At the time of the incident Jared Kellner was on a summer fest outing with the Wosinski family. During investigation, it was found that the panel that fell was hammered for placing it on the site instead of being fitted into pre drilled holes by using stainless steel sleeves and the panel was not attached using 4 top connections as was prescribed but instead just 2 top connections.
The Plaintiffs, Steven Wosinski was represented by attorney Timothy Andringa, Dawn Kellner was represented by Allen Foeckler and Milwaukee County was represented by attorneys Ross Anderson, Anthony Anzelmo and Thomas Ewing. Defendant Advance Cast Stone Co. was represented by attorneys Matthew McClean and Nelson Philips.
The total amount of combined damages for all parties is $39 million. $15 million for punitive damages alone. Various percentages of responsibility were assigned to the different defendants, with Advance Cast Stone assigned the bulk of it at 88%.
