Summary
Jahnke and Sons held a group policy with BCBS until 2008 when they decided it was no longer necessary to have maternity coverage. BCBS supposedly issued new indivdual policies to all the employees. Samuel R. Jahnke underwent a surgery to remove tumors from his brain. When he filed a claim with BCBS, he was denied on the basis that there was a 240 day waiting period. BCBS then contended the claim was covered by ERISA.
