The plaintiff claims that the rear braking system used in the Yamaha golf car was ineffective and had a history of causing rollovers while traveling downhill. Despite this, Yamaha refused to install a safer four-wheel braking system.
Representatives for Yamaha claim the golf car was improperly modified. Before Mr. and Ms. Hall purchased the vehicle, previous owners added modifications that compromised stability and increased speed. Along with Mr. Hall's failure to pay attention to the road, they assert that these modifications caused the crash.
