Gas Transmission of FL v. DOT

VERDICT

Trial
01/05/11 – 01/27/11

Summary

In this Energy industry commercial litigation proceeding, plaintiff Gas Transmission Company of Florida alleged State of Florida Department of Transportation of being liable of paying the costs of relocation of gas pipelines located alongside the Florida Turnpike, SR 91, in southeast Florida because of a Turnpike expansion project. The turnpike built a toll road in the 50's and 60's, and Florida Gas bought the rights to exist alongside it. Over the years the turnpike moved closer and closer to the pipelines as it was widened and expanded. The pipeline has been relocated and upgraded, but the parties did not agree on who was to blame and who should pay.

The plaintiff was represented by attorneys Daniel Bishop, Ethan Loeb and Tom Ferguson. The defendant in this case, State of Florida Department of Transportation (DOT) was represented by attorneys Jennifer Nicole, Jeremy Hart and Michael Marcil.

The jury rejected most of the claims asserted by both parties, including trespass, breach of easements, and promissory estoppel. However, on Florida Gas's reimbursement claim, the jury awarded the precise amount requested by the plaintiff: $82,697,567.

Outcome

Florida Gas's claim for reimbursement.
