Summary

In this Engle progeny tobacco litigation proceeding, plaintiff Phyllis Fraizer alleged Philip Morris USA Inc. and R J Reynolds of fraudulent concealment of dangers of smoking cigarettes manufactured by the company, which led the plaintiff to get addicted to smoking at age 15, around 1960 and made him a pack a day smoker for 30 years. The plaintiff also alleged the companies of manufacturing, defecting cigarettes which caused her emphysema or chronic obstructive pulmonary disease (COPD) in 1991. The plaintiff claimed that she quit smoking eight months later with the assistance of a nicotine patch. Ms. Frazier underwent a successful lung transplant in 2003, but her body subsequently rejected the new lungs, and at the time of trial she still suffered from COPD.

The plaintiff was represented by attorney Philip Gerson. The defense in this case comprised of R J Reynolds and Philip Morris Tobacco Co. R J Reynolds was represented by attorney Geoffrey Beach. Philip Morris Tobacco Co was represented by attorneys Lori Schultz and William Geraghty.
