A motion to dismiss a lawsuit that accuses the San Marcos Unified School District of behavior that caused a crippling brain injury to the Mission Hills High School football player in 2007 was denied by a Vista Superior Court judge Tuesday.
Judge Thomas Nugent ruled that the case should proceed to trial, and that the testimony of key witnesses should be heard witnesses who say Coach Chris Hauser put Eveland into the game against the recommendation of his athletic trainer. The senior linebacker collapsed in the second quarter, suffering from an injury that has left him in a mostly vegetative state ever since.
Some in the legal community have said because Eveland may live a full life that will require constant medical attention, the potential of a huge jury verdict or settlement exists perhaps one of the largest personal injury verdicts ever in the county."
