Derika Moses v. Riverside Community Hospital

VERDICT

Trial
10/12/22 – 11/10/22

Summary

After undergoing a spinal fusion surgery, Derika Moses was allegedly left disabled, resulting in her requiring a slew of medications. After five years, she had to have the implants removed, which she asserts caused her issues.

Moses sues Riverside Community Hospital, claiming that the hospital used "imitation" screws that the FDA did not approve. According to her attorneys, the company that provided the screws obtained screws with fake branding from a small manufacturer after it was cut off from its original supplier. Moses argues that Riverside Hospital knew of the substitution, yet continued to use these devices, in violation of hospital policy.

Representatives for Riverside Community Hospital argue that their doctors secured informed consent from Moses and relied on outside FDA investigations that did not raise issues with the screws.

Outcome

Verdict for defendant.
