Summary

In this oral argument before the Delaware Supreme Court, the attorney representing defendant James E. Cooke contended that the trial court abused its discretion when it failed to grant a mistrial when it was discovered, after the verdict, that a juror had failed to properly answer voir dire. On June 16, 2005, Mr. Cooke was arrested and charged for the murder of Lindsey Bonistall, and the burglaries of Amalia Cuadra and Cheryl Harmon's apartments. On August 9, 2005, Mr. Cooke was indicted for murder first degree,
felony murder first degree, rape first degree and numerous other felony offenses. A penalty hearing began April 18, 2012 and ended May 3, 2012. The jury recommended death as to murder first degree (intentional) and recommended death as to murder first degree (felony). Mr. Cooke filed a motion for a new trial which was denied on July 24, 2012. On September 17, 2012, Mr. Cooke was sentenced to death.

Outcome

The judgment of the Superior Court was affirmed.
