Summary

In this Engle progeny tobacco litigation proceeding, plaintiff Pamela Ciccone (personal representative of the estate of George Ciccone) alleged R.J. Reynolds Tobacco Co of fraudulent concealment of dangers of smoking cigarettes manufactured by the company which led her husband George Ciccone to get addicted to smoking at an age of 11. The plaintiff also alleged the company of manufacturing defective cigarettes which resulted in Mr. Ciccone death due to Chronic Obstructive Pulmonary Disease (COPD) and lung cancer.

The plaintiff was represented by attorneys William Wichmann, Mark Millard and Brian Depew. The defendant in this case, R.J. Reynolds was represented by attorneys Kevin Boyce and Robert Faxon.

The jury found that RJR cigarettes were defective, and the RJR's conduct was grossly negligent. However, the jury allocated 70% of the fault to Mr. Ciccone, and only 30% to RJR.

The jury awarded $196,222 in medical expenses, $1.08M in past general damages, $1.9M in future general damages, and $50K in punitive damages.
