Summary

Cheryl Cooper was arrested and charged with several drug related charges stemming from the search of her residence on October 18, 2012. On February 15, 2013, a hearing was held and the motion to suppress all evidence secured through an unlawful search was denied. A non-jury trial was held March 12, 2013, Ms. Cooper was found guilty on three of the four counts and sentenced immediately. In this oral argument before the Delaware Supreme Court, the sole issue on appeal was whether Ms. Cooper who based upon the uncontested testimony of two witnesses in the premises where the search was conducted had standing to move to suppress.

Outcome

The judgment of the Superior Court was reversed and the matter was remanded for further proceedings.
