Warner argues that laser etchings on the titanium used in the Profemur R were significantly deeper than recommended. His attorneys state that, while rare, this break allegedly caused him to suffer numerous surgeries totaling hundreds of thousands of dollars in medical expenses.
Wright Medical Technology insists that Dr. Brad Penenberg, the surgeon who recommended the hip implant, failed to properly affix the device. Additionally, attorneys for the company highlight the rarity of these fractures, claiming that this was the only product in over 9000 that fractured at the laser mark.
