Summary

In this oral argument before the Delaware Supreme Court, the issue on appeal was whether the Court of Chancery erred in dismissing the complaint filed by Anthony Murray and other plaintiffs against the Town of Dewey Beach for lack of subject matter jurisdiction. The complaint, which was filed on August 15, 2011, claimed that a Mutual Agreement and Release entered into by the Town of Dewey Beach with a private landowner was an invalid exercise of the town's municipal authority.

Outcome

The Court of Chancery's judgment was affirmed.
