In moving for a mistrial in Morse v. R.J. Reynolds, defense attorney Jeffrey Furr says a statement by Dr. Shannon Miller comparing the number of smoking-related deaths each year to the deaths in the 2001 attack on the World Trade Center was calculated to inflame the jury. Judge George Turner granted the defense’s motion in the Engle progeny tobacco case.
