In granting the defense’s motion for mistrial in Morse v. R.J. Reynolds, Judge George Turner says Dr. Shannon Miller’s comparison of smoking deaths to the deaths in the September 11, 2001 attack on the World Trade Center may have had a subliminal, inflammatory effect on the jury in the Engle progeny tobacco case.
