Georgia Judge Denies Motion to Dismiss in Suit Over Faulty GM Ignition Switch

Judge Kathryn Tanksley questions defense attorney Brian Sieve as to whether Kenneth and Mary Elizabeth Melton must submit a formal motion to set aside a prior judgment before proceeding with their action to rescind a $5 million settlement and renew their wrongful death claim against GM over its defective vehicle ignition switches. Judge Tanksley ultimately rejected GM’s arguments, allowing the Meltons' action, which also alleges that GM covered up knowledge of the defective switches, to proceed.
